check box on the group to exclude the taxes from the commission if the rate is CUSTOM

Since the groups are using a custom rate, there is nowhere to choose to exclude the taxes from the commission calculation based on the current functionality.

If you use a rate code for the groups, on the rate you check the boxes under the commission section to show which charge codes need to be included in the calculation
